Abstract:This research begins with an introduction and followed by discussing the concept, sources, aims and characteristics of punishment in Islam. It discusses mitigating factors of punishment in Islamic law and civil laws. The objective and the aims of the research is to bring up those factors in details and to compare both of them. The method employed is library research where references have been made to related sources including hadiths, books on law, cases, journals and related codes. While discussing mitigating factors of punishment in Islamic law, the writer directly discusses several hadith regarding the topic and incidents happened in R&il Allah (s.a.w)‘s time. The main focus of research on mitigating factors of punishment in civil law is criminal cases in Malaysia wherewith related acts, journals and codes are brought up. The writer also compares the said factors in both laws. This research ends with a conclusion for all the previous chapters.
